Terms of Service

The agreement between you and virtualcam.ai for using the real-time AI character camera.

1. Who we are, and agreeing to these terms

virtualcam.ai (“we”, “us”) is a real-time AI character camera that replaces your head and hair in your live webcam feed with a chosen persona. By creating an account or using the service you agree to these Terms, our Privacy Policy, our Biometric Privacy Notice, and our Acceptable Use Policy (the AUP is part of these Terms). If you do not agree, do not use the service.

virtualcam.ai is currently an invite-only beta. The operating legal entity, governing law, and dispute-resolution terms will be finalised before general availability; when that happens we will notify you and ask you to re-accept updated Terms. Until then, legal notices go to [email protected].

2. Who can use virtualcam.ai

You must be at least 18 years old (and the age of majority where you live) to use virtualcam.ai. The service is not directed at minors, and generated content may never depict minors - see the AUP.

3. The service

virtualcam.ai transforms your live webcam feed in real time on cloud GPUs and returns the transformed video to your browser. Today that means Backstage (a private rehearsal studio), persona uploads, and optional session recording. Further output integrations (an OBS virtual camera and similar) are planned and will be covered by these Terms when they ship. We may change, suspend, or discontinue features of a beta product at any time.

Because virtualcam.ai gives you a photoreal synthetic face, these rules are strict:

5. Your content and output

You own your camera feed, any images you upload (when uploads ship), and the transformed output. You grant us a limited, worldwide, royalty-free licence to host, process, transmit, and transform that content solely to provide and operate the service for you (including safety moderation as described in the Privacy Policy). This licence ends when the content is deleted or your account is closed, except for records we must keep for safety or legal compliance. We claim no ownership of your likeness, and we will never take a perpetual or irrevocable licence over it.

6. Safety moderation

We use automated systems, plus human review of flagged material, to enforce the AUP, including (as we roll them out during the beta) periodic automated safety checks of sampled still frames from transformed session output. Details, including retention of flagged frames, are in the Privacy Policy. We may remove content, suspend or terminate accounts, and report illegal activity (including suspected child sexual abuse material, which we report to NCMEC or the equivalent authority) without prior notice.

You can stop using virtualcam.ai and delete your account at any time. We may suspend or terminate your account for breach of these Terms or the AUP - for serious breaches, without refund. Sections 5, 6, and 9–12 survive termination.

9. Disclaimers

The service is provided as is and as available, without warranties of any kind, express or implied. We do not guarantee uninterrupted service, GPU availability, or any particular quality, similarity, or fitness of the transformed output. Nothing in this section limits rights that consumer law gives you and that cannot be excluded.

10. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, and our total aggregate liability is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US$100.

11. Indemnity

You agree to defend, indemnify, and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of content you create, upload, process, or distribute with the service, your breach of these Terms or the AUP, or your violation of any law or of any third party’s rights - including another person’s likeness, privacy, or publicity rights.

12. Changes to these terms

We will notify you of material changes (for example by email or an in-product notice) and, where a change is significant - such as finalising the operating entity and dispute-resolution terms - ask you to re-accept. Continued use after non-material changes constitutes acceptance.
